witness in registration of documents

Querist : Anonymous (Querist) 22 May 2010 This query is : Resolved

can anybody tell me , who can become a witness while registering a document , is he or she needs to know all the details of the documents or he is the witness that the registration process was done properly and and all the relevant parties were present at the time of registration . can any beneficiary or his indirect benificiary can become a witness.

There is no hard and fast rule as to who can act as a witness. If the person is a major and is of sound mind he can be a witness. Further, a witness is Person who witness the registration and is generally a friend / known person.

Hi !

Any person can become a Witness for registration of any document except Will. As in case of Will the person who is beneficiary could not become a Witness. There is no need that the witness should no everything about the document as he is only admitting the execution of documents and not the contents therein.

Witness is supposed to know even the contents of a document under registration, otherwise he will be called as a "stock witness".

A witness who is a major under Indian Majority Act, Sound mind, not a beneficiary to the document can be a witness
neighbour, friend, children/parents/siblings can be witness

I have similar opinion as of all other experts on this subject.
