an employee was trapped ACB and suspended after 2 years, he has reinstated. he served one year of service but the ACB case not finalized. now the employee has asked for earned leave for his personal grounds. he is entitle for apply for leave for his personal ground

No. Unless his case is finalized, he is not entitled to avail his leave.

He can avail earned leave from the credit balance existing prior to suspension.

He can avail earned leave depending upon the balance of leave in his leave records and sanction from the leave sanctioning auth who will satisfy that the EL so availed will not affect disciplinary proceedings in any manner.
