Acts mostly done not very meaningfully. if criminal amendments mostly confusing why even whether law maker and legal drafts man did understand is another question, besides your fluency in foreign language - english- is really doubtful ,when so you expect the accused shd have known laws, is it feasible common sense proposition!

this amendment is really not very meaningful; as it is, criminal acts must necessarily be meaningfully simple, else crimes would go on increasing...

Friends and learned folks My query is related to Section 8, subsection 1, Para 2 of E.C.Act, 1923. which reads as follows 8(1)... Provided that, in the case of a deceased workman, an employer may make to any dependant advances on account of compensation of an amount equal to three months' wages of such workman and so much of such amount as does not exceed the compensation payable to that dependant shall be deducted by the Commissioner from such compensation and repaid to the employer." Me and one of my advocate friend were discussing this and have developed difference of opinion. According to me, verbiage of the above para suggests that the employer making too much of excessive payments directly to dependents of deceased employee are exposed to risk of not receiving deduction from the commissioner. Particularly, if compensation computed works out at 3,50,000 and employer paid 4,00,000 directly to one of the dependents, he may not only not be entitled to get refund of 50,000/-, commissioner may also treat 3,50,000 as still outstanding.

Though this section states there shall be charged no fee for transfer from one state bar to another- nonetheless the State Bar Councils still charge transfer fee, that too with retrospective effect. In Particular transfer from UP Bar Council to Maha & Goa Bar Council.. Questionable and an arguable point.. Bar Council Rules can't over rule Advocates Act under which these rules are made.. Major contraction in law...

As I know there is an amendment in section 3 of the Act by the BJP govt in centre that the parents should be citizen of India not either of them.

Further, vide notification No. S.O. 2016(E) dated 19th December, 2011, the amount of medical bonus has been increased from Rs. 2500/- to Rs. 3500/-..Kindly update this notification in the act.
