POST OFFICE CASH CERTIFICATES ACT, 1917

STATEMENT OF OBJECTS AND REASONS "The form of Post Office Cash Certificates contains the following inscription printed thereon :

Not transferable except with the permission of the Post Master General and non-transferability has from the first been a condition attaching to these certificates. This restriction, however in the absence of specific legislation would not be operative against the general right of transfer of all actionable claims conferred by Section 130 of the Transfer of Property Act, 1882. The present Bill provides for the validation of the above-mentioned restriction, except where the cash certificates form part of the estates of deceased persons, or are necessarily transferable by operation of law, e.g., as in the case of the holder's insolvency. Opportunity has at the same time been taken to place the payment of cash certificates belonging to the estates of deceased persons on the same footing as Government Savings Bank deposits forming part of the estates of such persons."-Gazette of India 1917, Part V, page 75.

An Act to restrict the transfer of Post Office 5-Year Cash Certificates and to provide for the payment of Certificates standing in the name of deceased persons. WHEREAS it is expedient to restrict the transfer of Post Office 5-year cash certificates and to provide for the payment of certificates standing in the name of deceased persons; It is hereby enacted as follows:-

This Act has been extended to Berar by the Berar Laws Act, 1941 (4 of 1941)and has been declared to be in force in the Khondmals District by the Khondmals Laws Regulation, 1936 (4 of 1936), S. 3 and Sch., and in theAngul District by the Angul Laws Regulation, 1936 (5 of 1936), S. 3 and Sch. This Regulation has now been repealed by Orissa Act 19 of 1967 and Angul is a sub-division of Dhenkanal district of that State. It has also been applied to Porahat Estate, in the district of Singhbhum by the Porahat
Estate Laws Regulation, 1945 (Bihar Regn. I of 1945), retrospectively.

This Act has been extended to the new Provinces and Merged States by the Merged States (Laws) Act, 1949 (59 of 1949), S. 3 (1-1-1950) and to the States of Manipur.Tripura and VindhyaPradesh by the Union Territories (Laws) Act, 1950. (30 of 1950), S.3 (16-4-1950), Manipur
and Tripura are States-See Act 81 of 1971 .Vindhya Pradesh has become a part of M. P. State See Act 37 of 1956, S. 9. Act extended to Sikkim-See S.O. 529(E)/1983-Gaz of ind.. 29-7-1083, Pt. II. Section 3(ii), Ext., p. 4 (No. 329) and enforced on 8-9-92-See Gn/. of Ind., 8-9-92. Pt. II, S. 3(11) Ext., p. 2 (No. 386). The Act has been extended to the Union Territory of- (1) Goa, Daman and Diu by S.O., 2734 published in G.I., 1962, Pt. II. S. 3(i), Ext.. p. 1991. (2) Dadra and Nagar Haveli by Regn. 6 of 1963. (3) Pondicherry by Regn. 7 of 1963 (1-10-1963).

SECTION 01: SHORT TITLE

This Act may be called The Post Office Cash Certificates Act, 1917.
