Official Trustee may with consent be appointed trustee ofsettlement by grant or.- (1) Any person intending to create a trustother than a trust which the Official Trustee is prohibited fromaccepting under the provisions of this Act may by the instrumentcreating the trust and with the consent of the Official Trustee,appoint him by that name or any other sufficient description to be thetrustee of the property subject to such trust: Provided that the consent of the Official Trustee shall berecited in the said instrument and that such instrument shall be dulyexecuted by the Official Trustee. (2) Upon such appointment the property subject to the trust shallvest in such Official Trustee, and shall be held by him upon thetrusts declared in such instrument.
