Delhi HC Rejects Plea For Demolition Of Workers Homes 1/23/2009 The Delhi High Court restrained the Land and Development authority(L&DO) to demolish the houses of the 50-odd staff quarters of the well known National Sports Club of India(NSCI) which they say are illegal occupants of the land. Justice S Ravinder Bhat directed the L&DO to go by legal process and if they want to demolish, they should adopt a policy and give proper notice to the occupants so that they are not rendered homeless in the chilly cold, the court said. Justice Bhat directed the lawyer of L&DO Mr Katyal to follow the procedure--First conduct a survey and establish who are the original allotees and then establish who have encroached upon the public land. The court directed to determine as to who is the authorised occupant and who is the unathorised one. Mr Katyal told the court ‘The occupants of the land were seeking alternate plots which we cannot give as most of the land belongs to a private club which is leased out to them by the government. We can rehabilitate only those who are on the Government land.’ The court said, ‘Even if you cannot rehabilitate them, you have to consider the request of the petitioners in a humane way and give them time and notice to vacate the premises, if you have to dislocate them. Matter pertains to the land behind the NSCI club in which many of the club employees have staff quarters. Originally about 50 years ago, 28 staff members were allotted quarters but now almost 300 occupants are there. The occupants, club and L&DO, all agree that many illegal occupants have come up in the area in the past years now and cannot be accommodated elsewhere. The Court gave six months time to the government to conduct survey and then go by rules to evacuate the illegal occupants. UNI
