Importance Of Alternative Dispute Resolution Methods Stressed: CJI 2/15/2009 Chief Justice of India K G Balakrishnan underscored the need for changing the style of functioning of lawyers and courts and promoting alternative dispute resolution methods for speedy and affordable resolution of disputes. ‘Our lawyers and the courts should change their style of functioning to redress the huge pendency of cases in courts and there is also a need to promote alternative dispute resolution methods (ADR) of conciliation and mediation as a way of providing speedy and affordable justice,’ the Chief Justice, said while speaking at a conference on the ADR organised by International Centre for Alternative Dispute Resolution (ICADR). Mr Balakrishnan also emphasised upon making the judicial system more accessible to the people living in remote areas by setting up more courts at village level to ensure that the villagers can seek legal help easily. Speaking in the conference, attended by prominent Supreme Court and High Court judges and legal luminaries, Union Law Minister H R Bhardwaj criticised the ‘monopolistic Bar Association’, charging it with showing ‘total non-cooperation’. In an oblique reference to the recent protests by lawyers over certain amendments made in the CrPC, he said the government always sought their opinion before coming out with any major change and the Bar members should give their suggestions beforehand and show a cooperative and professional attitude in the courts. Adhocasism in the courts becomes a frustrating exercise,’ he said. He also called for improving the legal education system to enable the young lawyers compete with international lawyers. UNI
