sec 143 (a) amendment)

(Querist) 07 March 2019 This query is : Resolved
Hello,

I have a matter going on in the JMFC. The matter was registered in 2017. Now when the trial is starting the complainant has put in an application for Interim compensation u/s 143 (A). I would like to know whether the complainant is eligible to apply for the application u/s 143 (A) for old matters

Dear Sir,
The Amendment Act says that it will come into force as and when Central Government issues a notification to that effect. Please check whether any such notification is issued otherwise such amended provision cannot be implemented. It is for the complainant to produce such notification to take benefit of such amended provision.

Please mark “LIKE” if satisfied by my answer.

Section 143 IPC provide "Punishment for Unlawful assembly", what about amended provision ? Has it (amendment) come into force ?

Sir you have to give details of case pending before court so that appropriate remedy can be suggested..still if any interim application is filed you may submit detailed affidavit in reply raising your grounds of objection.
