Costs for appeal

Hi Sir,
My father has an issue with another guy in money transactions. He filed a case against my father with pro note and checks. Here is court order.

Business : Judgment pronounced in open Court (vide separate one). In the result, the suit is decreed with costs for Rs.6,86,933/- with subsequent interest on the principal amount of Rs.4,00,000/- at 12 percent per annum from the date of filing of the suit till the date of decree and thereafter at 6 percent per annum till realization.

Do we need to go for appeal in higher court and how much cost do i need to pay??

State: Andhra Pradesh District: East godavari Court:Court of Senior Civil Judge., Ramachandrapuram Case Number 82/2015. Order dated: 01-09-2015 Act:CODE OF CIVIL PROCEDURE, 1908 (HB) under Sections 26,Or.7,R.1 So we went for reopen the case for further investigation till we failed to prove he's submitted false doc's. so now we want to go for appeal. We need to know how much we can pay for appeal.

How has the Court of Civil Judge (Sr. Div) calculated the amount of 6,86,933 and subsequent interest of 4 lakh @12% p.a.?

Appeal against a decretal amount of 6,86,933 + 4,00,000= 10,86, 933 shall be accompanied by ad-valorum Court fees as applicable in AP (differs from state to state) calculated to Rs. 5,426 (for 3,00,000/-)+ 100 for 10,000 for every 3,00,000 , which may further be added for the interest @ 6% accrued.

Academic nature of query is quite apparent. Otherwise, on the issue the querist was supposed to have consulted his own lawyer through whom he had already fought the case, or some other lawyer through whom he would have preferred the appeal.

If he wanted to file and appeal directly to be fought by himself, he may better satisfy the decree by paying the decreed amount to avoid any further huge cost, including interest and botheration for years together for himself after filing appeal.

You had mentioned about Ms.Usha Kapoor as " impersonating expert ".To my knowledge she was a Legal Officer to reputed company and she is presently at home due to her unhealthy condition and finds difficult to walk also.Her husband is a retired Senior Bank Manager. Still she is trying to help the querists with her level best with out any expectation and getting "Likes " points is obviously a hobby for her with no intention of any mistakes.I humbly request you even if you wish not to encourage her Please Do Not Insult her.It is my humble request.hope you would understand please

There is a marked difference among the terms, appreciation, sympathy and pity. Similarly, there is a marked difference between impulsive/ spontaneous appreciation and demanded (begged) appreciation.

You can very well understand, what type of your support towards Ms. Usha kapoor through your post can be considered. Certainly, if you have extended your support for her misleading advice on hit & trial basis, that cannot be termed as appreciation for her on your part. Further, sympathy towards her on your part can be understood, but your unsolicited post on the thread in her support for misleading advice is demonstrative more of showing your pity towards her, rather than a sort of sympathy on account of her woes.

Further you can also understood very well that if someone volunteers to give some free service that can be appreciated, provided that is not associated with some demand in lieu of service, more particularly for any misleading advisory service.

In this case, she made a demand for liking of the querist that too for her misleading advice on hit & trial basis. If she decided to respond to the query on court fee that should have been either exact amount of fee, else there should have been no reply with any approximate fee. So, the demand for appreciation can well be treated as begging for "like".

Hope, you would like to appreciate that appreciation should have been voluntary on the part of the author of the problem, if satisfied with the advice. But in this case, you would have noticed, the querist has raised two supplementary questions after her advice, which reveals that he was not fully satisfied, but he gave appreciations merely on demand by the expert.

So, your post aiming at Dr. J.C. Vashista was not justified in any way.

Even in side the Courts the advocates would address each other respectfully as " Learned Counsel of other side" and mostly they would avoid addressing with names with out any Mr/Mrs/Ms. Better to avoid to reply when we can not expect dignity from some one who advises. Ignored Please

My lawer is advises to go for appeal with 52,000 /- as court fees. what are the chances to win the case? Can we Win the case?
I don't know how the court calculated the interest and subsequent amount.?

I think Mr. Dhingra is right in his opinion. If someone has demanded the amount of Rs. 10,000/- from this querist, Mr. N.J.S Rajkumar may like to name him openly.

If the allegation is not related to the case of the present thread, although it was irrelevant for him to make any reference in this post, but still Mr. NJS Rajkumar should make the clouds clear even in this very thread.

About "likes", I am also going to give to Ms. Usha Kapoor for her sincere efforts, may that have served the purpose of the querist or not..

Someone personal messaged me. First he ask me to send order copy then he'l dig into case to chances of success.
i sent order copy. after i sent order copy he asked me as "Can I expect any fee for working on your case". and in second mail he said "I have gone through your Judgment. You will be succeeded . Call me" given his number.
I told him "Sorry sir i don't think its a paid service".
As far as i know this site is helpful in know the things about our law and how to proceed from answers given by our Experts. No one is demanded any money from me. He just asked and i rejected.

Your statement about no intention to embarrassment to the concerned person has no logic, when you have already made a post aiming at embarrassing someone. Apparently, not coming forward with any such name of the concerned person can only be the intention to cover up your pitiful support to the expert here, when any such incident was not related to the present query or the author of the query.

If you ask my opinion about your style of bringing forth the background of Ms. Usha Kapoor, please excuse me for my frank opinion. In my view that can be termed as a deliberate attempt on your part to inflict an insult to Ms. Usha Kapoor, as that was indicative of showing pity for her openly on your part. Otherwise for what specific purpose such background of the learned lady was revealed without any concern with the query., Of course that is good, if by sharing her knowledge freely with the needy persons she is able to pass her time hasslefree?

No objection, if you refused to avail personal help of some expert on payment basis. But, if someone wastes his precious time and infrastructure at a substantial cost on this forum just to help the needy persons in trouble that does not mean that he is obliged to devote his whole time for free service to others by wasting his precious time and incurring huge cost even on infrastructure, like hardware, software, internet, electricity, besides rentals, furniture & fixtures of his residence at the cost of displeasing his family members by not sparing any time for his family affairs and day to day needs.

Even in your company's case, on what specific ground you would have desired free service, when your company can very well afford the cost of consultation. So, why do you believe that any expert should spend money for the sake of your company and to add more profit to your company's account.at his own cost without any return in lieu of that..

So, your expectation of free service privately also from any expert is quite illogical.
