SIR, COULD YOU PLEASE PROVIDE ME A FORMAT OF WRITTEN ARGUMENTS IN S.420 OF IPC.

Dear Y T R Rao,

There is no particular format for written arguments.

 

In fact it is your argument in support of your client given in written mode.

 

You may start by saying the accused is innocent and a false case is foisted by police/complainant.

Discuss how the prosecution failed in proving the charge and the evidence in support of your client.

Support your arguments with decided case laws.

Oral arguments matter.What's the use of writing best possible written arguments when a lawyer can't cow down the judge and the opposite party? A good advocate is excellent in oral communication and picks up the weakest point of the opposite party and makes his point. Judges hardly have the time to read written stuff.

It is true that arguments before the Court do make an impact, but to assume that Judges are all ears to the arguments and will pick up the weakest point is also expecting too much.

 

It is better to submit oral arguments and followed by written arguments.

Depends on the advocate how he represents written plus oral. Theoretically none of the two options is an exception to any rule. Depends on judge too.
