Vechicle Theft Insurance claim.

Resp Members,

Vehicle is insured with insurance company also, other papers such as Driving Licence, tax etc are available and it’s a private vehicle,.The owner of the vehicle has given the vehicle alongwith its driver to his friend, who has taken the vehicle outside the city for official work of his company.

The vehicle was in possession of owner’s friend, who was using it for his official work and the said vehicle got stolen, thus , immediately, complaint is submitted with local police station.

In the above case, can insurance company reject the claim of owner because -: 1) Vehicle was not in possession/ control of owner at the time of incidence. 2) Vehicle owner’s friend was using the vehicle of his commercial interest and or his official work under the instructions of his employer, with whom vehicle is owner is not related. 3) Any other reason.

No, claim can not be rejected; 2) If vehicle was used for commercial purposes, claim will be rejected; 3) If vehicle was used without owner's knowledge/permission, claim will be rejected.  Vasudevan

In this matter, the Insurance Co. cannot reject the claim. The Insurance Co. is liable to pay.
