Usage of excessive fsi

Hi Sir,

As a Junior Advocate i am asking this query,

There is an construction activity going on next to  one of my client's place of residence in mumbai. The builder is using excessive fsi. Now my client is having objection to this activity as its affecting my client's interest. Pls let me know what action can i undertake against the builder.

Can i submit an rti application to the concerned authority regarding the fsi that can be used regarding such activity by making development plans of the same from an architect or should we file a pil in the high court regarding unauthorised constructions.

Pls advise.

Regards,

Adv Nitin P Kotian

Nitin,

What u mean by excessive FSI

I hope builder is not doin unauthorised construction if YES then simply Complain BMC About it  the new Commissioner is very strict about it

By using RTI u will get all d approved plans from BMC pertaining to that property but if there is no irregular activity in d site u cant do much if u succeed in it builder can get stay/injunction against u n BMC

PIL in HC will be rejected d grnds shud be stronger

regards

Abhijeet
