Undivided share in an apartment

I reside in an apartment complex in Bangalore.  The apartment is build on 20000 Sq.Feet land.  The Builder planned to build 40 flats in this area.  Therefore, while purchasing the flat.  He had allocated 500 Sq.feet of undivided share to each of the flat owners (this is equal allocation to all, not proportional to their flat size).  This is so far so good.

Unfortunately, he has constructed another floor (unapproved, with 4 flat).  Now for these flats also he as provided undivided share.  This means, total undivided share distributed is 22000 sq.feet. Whereas, the land available is 20000 Sq.feet.  

On questioning on this, he said.  Still he has some more flats to register (around 10 left, unsold).  I will make required changes there.  How can an individual flat owner check this and legally take action against builder for violating UDS allocation.  Can I send a legal notice to builder on UDS allocation and seek full statement of what is allocated to all flat owners.
