Transit remand comes under sections 80 and 81 of the CrPC. According to section 80 of the CrPC, when an arrest warrant is issued and the accused is not within the jurisdiction of the local magistrate (not more than 30 kilometers). The court will direct the police to go where the accused is and with the help of the Executive Magistrate, the office of DSP or office of Commissioner of police arrest the accused.
However, if the accused has provided security under section 71 of the CrPC, in cases of bailable offense, he will not be arrested. In cases of Non-Bailable offense, the accused will be arrested even if security is provided.
