Hello Querist!

Yes, High Court can exercise its power to set aside the order passed by the NDRC.

Dear Selva Raj, the original querist: your query cannot be answered so straight. Please clarify as to which order of the Forum to be stayed by the H.C? Is it the order passed by the District, the State or the National commission?

Only the state commission is the  Appellate Authority for District commissions and the National Commission for State commissions.

To: Adv.Rohit Sharma ji. Thank you for your. response. My interest is to know under which sec. of CPC, the High Court can exercise its power to set aside the order of consumer forum, while such power is vested only with St.Con.Com.

Dear Selva Raj, the sequence of appeal in consumer case is: district to state to National and the end. No H.C. is involved in appeal. After National commission you can approach the SC with the WP. Hence asked you the question in my previous post.
