Society maintenance

Our society was formed thru a Registrar order as builder was not cooperating.  WE have formed the society as per order and it is registered.  The builder has file appeal against the DDR order.  We are going ahead with transacting society's business as we are a recognized legal entity and builder's request for stay during appeal was rejected.  Maintenance is being carried out by builder who also refuses to do conveyance and we are going for deemed conveyance. In a GBM we have got the Maintenance charges approved by 100% majority.  The question is can we issue invoices for claiming Maintenance charges? Do we have to inform builder that he should not charge maintenance or is it implied that once society is formed builder does not have a locus standi
