Site and house owned by different people

Dear All,

I have a situation where a SITE is owned by my father. And I (SON) built the house on that site. Now my father wants to transfer that property to me.

Do I need to register the property with the value of both HOUSE and the SITE, or is there a way where in he transfers the SITE and mentions the House was built by me.

 

Please guide me through this.

in your case, it is desirable to transfer the property of both land with building. Because you cannot own the structure without any ownership over the land or right of construction  without permission of land owner. Therefore, I would like to advice to register both site and structure over the site.

Mr. Shanmugam Lakshmanan is right in suggesting you to transfer both the site and the house on your name but the recital in the deed may contain that house was built out of your own funds, there is nothing wrong in mentioning so in the deed.
