Resitered property - cancellation

Dear Sirs,

 

Kindly provide the following suggestions :

A daughter purchased a plot from his Father, on the basis her husband’s Income. It was registered in her name. Later,  she made it registration of the same plot to her brother’ name. After registration, his brother annoyed and to try to avoid to speak with her. She is getting mental torture.  She is having husband, two daughters and a son. Tne daughter was married the lady’s brother who is having her  registered plot.  She is living with her husand.   Will it be possible to take back the plot registration from his brother ? If, so where is the place, she has to approach  whether Sub-Registrar’s Office or Court ?

no if the name is transferred, it cannot be taken back.

the answer if negative, sale deed once done cannot be cancelled, it has to be re conveyed back to the seller, with the same amount of stamp duty. You can approach court for cancellation of sale deed, as it was done under coercion or undue influence, the onus is on you to prove the same and chances of getting through the case is less.
