Resale mmrada flat in mumbai

Dear Experts,


I would like to buy resale flat in MMRDA building in Mumbai. As per my knowledge, there are almost more than 40% of MMRDA flats have been sold based on Power of Attorny & Sale Agreement. I have following questions:

1) Is it legal to buy resale flat in MMRDA building in Mumbai?

2) What kind of papers should be made available by the owner to the purchser?

3) Can this flat will be transferred in to the name of resale purchaser?

4) What kind of legal documents need to be prepared for this transaction?

5) Can you please give an example in Mumbai, where MMRDA resale flat is transferred to resale purchaser?

6) If this flats can be transferred in future (after complition of 10 yrs of allotment), what are the process for said transfer of ownership?

Hi,

(1) You read a term and condition of MMRDA.

(2) U registration a Agreement For Sale / Sale Deed at SRO office and thenafter transfer property in your name.

(3) Notarized Power of Attorney and Agreement for Sale not velid if any litigation in Future. 

(4) U contact MMRDA Office and SRO office for that.
