Requesting advise

Hello,

 

My deceased father took a loan on my mother's name for Rs. 25000 from a bank around 3 years back.  He was paying that for almost two to three months, but after that he passed away.  Mom is an illiterate, and she is not holding any job.  She is currently living in an ancestoral property (which is in dispute and still undivided hindu property for the past 20 years).  I am just doing my college, and even i am studying in scholarship.

We are under immense pressure from bank as they still think the house belongs to us, even after we state that is a property in dispute, to repay the loan, or they will file a criminal suit for non repayment of loan.

I would like to know, if in case they file the suite, what would be the way for them to recovery, as my mom does not even have a single piece of property or any money in bank, nor does she have any relatives who can even pay the fines if any imposed by the court. 

We are unable to even pay any one if in case we end up in court.

Please suggest a way to help us with the legality of this issue....
