Rent claimed by partner in partnership firm

Sir,

My brother and me are parters. After a few years we decided that he will look after the business at Mumbai and I will manage  business in Pune. During this time as I was responsible for developing new products and made a few products. But my partner said that he is not interested in marketing it,as this was his responsibility. After a couple of years we decided to sell the property and disolve the partnership. At that time he is demanding 50 % Rent, at prevailing rates in Pune ,for use of the premises. There is no clause in the agreement that either partner needs to pay rent for the use of the partnership property. Nor did the partner at Bombay communicate that I need to pay rent, for subsequent use of the premises, either verbally or in writing.

So please tell me whether the claim is justified? The partnership has still not been disolved .

Your help in giving guidance will be appreciated.

Thanks in advance.

As stated facts, you need not pay rent.
