You have not posted in which your father died, whether property was self earned/acquired or it was HUF/ancestral, etc..... .did your father nominate anyone in society records...............was any NOC signed by you and three brothers in favor of mother. 

It is being believed that it was self earned/acquired property of your father and your father did not leave a WILL.

The suceesion opens upon death of owner.

Thus upon death of father the flat in (Mumbai/Maharashtra) should have devolved in the name of all ClassI legal heirs i.e. your Mother, you, your brothers (equally).

 

After the death of mother her share shall devolve upon you, your brothers (equally).

What is the opinion of your own counsel that has sent the legal notice?
