Payment of bonus and employment status

One of my friend has resigned. Company policy is to pay bonus of year 2015 in 2016 half jan and June.

Now that she resigned she only got half. Is there anyway she can claim the other half. The contract says that the employee has to be employed when the bonus is paid. Any way by which she can claim the other half legally?

This condition may get termed as unconscienable/unreasonable.

 

What is this Bonus: Some perfromance bonus?

Hello sir,

It is a cut of profits made out of the model which the employee makes, so ya i guess it will be a performance bonus. How can she go about it?

Since it is company policy the line managers/HR may not be able do anything other than forwarding it. The employee may write under proper acknowledgment to good offices of appointing authority, MD ,Chairman etc

 

Thereafter the employee can approach the appropriate forum.

It shall be better if the employee approaches an able counsel specializing in labor-service matters with all employment related docs and proceed further under the advise of the counsel.
