Minors (std vi) details revealed under "students not paid fee" and results held by school.

My Daughters results were held as we havent paid the school fees un full yet. Also, her name was declared as Students Not paid fee. Though we are trying from all ends to pay the fees and meet the deadlines, this was uncalled for.

I am sure as a minor, she would have certain rights and the school can be punished legally.

Please advice.

As per the act, education is a fundamental right of every child who is between 6 and 14 years old. The act also states that until the completion of elementary education, no child shall be held back, expelled or required to pass a board examination.

The Right of Children to Free and Compulsory Education Bill, 2008, is anchored in the belief that the values of equality, social justice and democracy and the creation of a just and humane society can be achieved only through provision of inclusive elementary education to all. Provision of free and compulsory education of satisfactory quality to children from disadvantaged and weaker sections is, therefore, not merely the responsibility of schools run or supported by the appropriate Governments, but also of schools which are not dependent on Government funds.

First and foremosst the school does not have any right in withholding your daughter's result with regard to non-payment of the fees which you had complied before writing the exam, You can approach high court under article 226 and 227 by filing writ of mandamus and getting directions from the high court of karnataka since your fundamental right is infringed.

.The school allowed your daughter to write exams, she wrote them and her papers also may have been valued, only her results were withheld. So, you have to approach Court asking for a direction to school to declare her results. The school has to answer legally in court.
