Maintenance criteria

A husband and wife are seperating / divorcing after 22 years of marriage.

The husband is unemployed and is earning Rs.20000/- per annum doing odd jobs as declared in his income tax return.

The wife is earning Rs.476000/- per annum doing fashion designing as declared in her income tax return.

Is the alimony demand of the wife tenable ?  

does the court have to take into consideration income of both parties to the case before deciding alimony ?

Can the husband ask for alimony ?

This is the question faced by our client and this post is merely to include any opinion/judgments missed by our office

She cannot ask for maintenance instead she should pay her if man ask for maintenence

You have not mentioned anything about the assets of the man and the woman (also their liabilities)

What about the children?
