Kindly let me know about my 498a

Hi,

  Currently my 498a case is in evidence stage. My wife and her witnesses are not turning up in court despite sending summons from the court. They have not turned up for 4 dates. Court has dropped them from witness list.

Now Police officers who wrote FIR needs to come as witnesses. They also have not come for one date.

I would like to know how long can this case be stretched like this. My Lawyer told Police will have to come as it is

an serious issue if they do not turn up.

   Kindly let me know what will happen after police comes. How many more dates I am going to get?

most of the witnesses have been dropped and only police is remaining.

I think you would be set free by court from 498A. All the best.

no private witness joined by police and your wife had not come from many oppotunity by the court at this stage if complainant did not give his evidence, the chances for your acquital be increased.

mere oral allegations are sufficient for conviction in 498a trial.

Hi,

  The Case was about to be dropped.My wife did not appear for around 12 court dates. Now

she appeared and case will be running. I would like to know what is the court procedure in

sequence wise.

 I mean now What I udnerstand is

1. The PP will examine my wife and witnesses

2. My Lawyer will examine my wife and witnesses. 

Kindly let me know after above 2.

  What will happen if witnesses does not apear? Court already gave them time and nobody

appeared.

  Will court kept on giving time and I will get dates after dates? 

When should I approach the High court or speedy justice for the case?

Seems it is another delay tactics by wife.

 

From my limited legal theoritcal knowledge, if wife is not turning up for 2-3 dates we can ask judge to issue Bailable warrants .. I would stand corrected by experts advise on this.
