How long will it take for divorce process to complete

Hello experts,

 

How long it will take to complete the divorce from the day of filing petition, if its is a contested and the wife is earning as much as husband.

1.  If your lovely wife wants to contest divorce petition, it takes 7-8 years for sure to get divorce decree.  Thats divorceeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeee.


2.  IF wife jolly well agrees for MCD, it takes not more than 18 months to get divorce decree.  Thats divorce.


3.  If your wife files some false cases on your and your immediate family like 498a, DV case, and other blah blah cases, it take another 5-6 years to get over.

 So totally 1 + 3 = 14 years.  So in 14 years you will be free.


If you have produced any kids, custody case, child visitation rights case all this will take 5-6 years to get over and also may extend up to 18 years until child attains majority.  Not to forget the alimony you have to pay to child till it attains 18 years.


Dont forget, if wife is working in private sector, you will still have to pay her alimony until the day she remarries.  If she goes in for livin relation then God save you, she will be fcuking someone easily and you will have to pay her alimony too.  Such maintenance case also takes 5-6 years to be decided upon.

My head started to spin after reading your response and thanks for the response.

 

We both work for the private sector and salary is almost same around 60k and we have no kids.

We were living together for just 6 months.

She filed divorce under section 13ia during may 2014 and i filed counter petition last week. How long this case is going to drag, Its in Bangalore family court.

She is demanding 30 lacs alimony and 15 lacs marriage expenses. I dont have any property in my name and there is no ansisteral property as well.

One year should be completed to file divorce or else divorce petition will get dismissed.   And you will have to file fresh divorce petition.

How long this case is going to drag, Its in Bangalore family court.

Explained above.  Dont think this is a joke.  Enquire with few local lawyers in bangalore, you will find umpteen lawyers in race course road just near the high court.  usually lawyers will misguide you that divorce case will get over fast, but thats not true.  They do it only to get more fees from you, these are tricks used by lawyers to get more n more fees.

Arrange for money, as per your capacity.  Bargain for the best price for your freedom.  Its same like vegetable purchase, they tell 10 you tell 5, finally after lots of bargaining, they settle for 7.  So arrange 7.  How you do the convincing is up to you, you may also take help of professional negotiators/mediators or ask someone from your elders in the family to bargain a price for your freedom.  If you are capable enough to arrange money what your wife is asking, then I suggest you do it, arrange money some how and get rid of the headache once and for all, doing like this will help you save 7-8 years of time and energy.

You can earn money, but cannot get back time.  Think about it and keep in touch with me regarding your case.

Yar bahut lucky ho jo aapki wife ne aage badhkar divorce file kiya,...der kiye bina turant accept kar lo ;)

 

Joke apart, it a harsh relality that when husband wants divorce  - it takes lots of years and pain

 

if wife wants - rarely to be seen and quite easy for her

 

So Consider yourself luck and accept it without any more delays...Also reg maintenanance, since case has been filed by her..it can be negotiated before court (considering her working and her willingness for divorce, not yours)...

So Move on and get free...
