Deemed conveyance

As per Maha Govt. we want to submit the Deemed conveyance proposal to the DDR (out society is in Vasai - Dist-Thane) . We discussed one consultant regarding the same and he advised us to first speak to the Land Owner. We had meeting with the Land owner where he came with following point saying he cannot covey the land : 

1. FSI to the said Layout is still balance - Layout having 5 societies

2. 25% of the total FSI is still not released by CIDCO with was on hold as per the approved plan

3. If we process for deemed conveyance he will put Court case while registerin the Deemed conveyance at the Sub-Registrar and he can stay on the registration process saying if the CIDCO -A govt. body is not fullfilling its committment of releasing the FSI why shoul I fulfil my comittment to the Flat Owner of givig the Conveynce?

4. FSI for open space, DP Road is still not received by him 

His main point for refusal of Conveyance is " BALANCE FSI"

In this situation can we process for the Deemed Conceyance? If process will this get completed or we will get stay?
