Quashing 498a - 1month old FIR

 

 

FALSE CASE U/S 498A & 406 HAS BEEN REGISTERED ABOUT A MONTH BACK. PARENTS GOT THE BAIL RECENTLY WHILE THE SON WHOSE WIFE IS IN INDIA SINCE 3 YRS IS IN CANADA.

WE HAVE ALL THE EVIDENCES AGAINST ALL HER FALSE ALLEGATIONS MENTIONED IN FIR & DV COMPLAINT. WE HAVE ALSO RETURNED THE GIFT ITEMS GIVEN BY GIRL SIDE TO POLICE UNDER SEIZURE NOTE & NO CONDITION BAIL HAS BEEN GRANTED.

IS IT ADVISABLE TO APPROACH HIGH COURT PATNA FOR QUASHING OF THE FIR AS FIR IS JUST 1 MONTH OLD.  WE HAVE ALL EVIDENCES ......STRONG EVIDENCES

If prima facie case is not been madeout u can file Discharge petition in magistrate court U/s 239 crpc, if u feel the primafacie case is been madeout and there are lot technical errors u can approach high court u/s 482 crpc but u cannot seek remedy on both only either of it u have to opt

File a criminal petition before the high court, for quashing the proceedings and also interim prayer for stay of the proceedings.Further get an anticipatory bail for you, if rejected, get rgular bail before the court.
