hi,
in case of a partition suit in district court ,
a) how soon can i file a execution petition soon after the final decree is received. do i need to wait for appeal period to get over?,if yes,what is the wait period?
b) does mere filing of appeal will put execution petition process on hold? or there has to be a specific stay order in place?
c) how easy is to get stay order on execution of final decree n case of immovalbe properties ? or is true that it s tough to get stay once the Executioin process has already been commened ?
d) i heard Exec petition proces is a separate suit by itself. what exactly happens in a execution petition for partitioning the property.will there be any summons sent to judgement debtors? can the defendant file counter for EP or does it have to be only through stay and appeal?
