Eviction of tenant

Have let out my residential house to one Muslim Lady on a eleven months rental agreement which expired in Feb 2012 no further extension. Ten months rental arrears was cleared in one lump recently. Many requests to vacate has fallen on deaf ears with vague reasons. Am a senior citizen also Cardiac and Carcinoma Patient. Can a Police complaint on this score be filed aginst the tenant for causing lost of tension and stress to a senior citizen and Patient which may deteriorate his health. know filing civil suits take more time hence this complaint. Pl. advise

Sir, filing police complaint will not at all help. I feel so sorry for your health issues. But civil litigation (evicition petition) is the only option you have sir. You can request for hearing on day to day basis showing your health issues, bit it will take sometime.

Sir,

If you have duly stamped & registered the Leave & License agreeement, you can take recourse to eviction proceedings under section 24 of the Maharashtra Rent Control Act and can get the eviction order at an early date, further you can also claim double the amount of daily license rent from the expiry date of the agreement.
