Parking sold to outsider

Hello Sir

My society in Ahmedabad has 150 residential flats. There are 50 basement parking spaces and equal number of open parking space on ground floor. Before 4 years, society's managing committee sold all basement car parks to a restaurant which is operational in the building premise (present in shopping area). We have gone to the court to cancel this transaction of the previous committee as we feel this was done with wrong intentions and parking is a basic necessity for the members. Is it legal for the society's managing committee to do so?

1.  It would be "illegal & unauthorised" to sell "basement parking" to ANYBODY, more specifically for commercial activities.

 

2.  Criminal cases, can be filed against the Society's Mg.Committee members, who signed such sale-deeds.
