Fir in depressed state

Hi all.........

I want to know what if the complainant in sec376 filed rape case in depression stae ... what if she is found to be a patient of depression ???? whether her FIR and 164 statemnt helds any value ?

In such a situation just because she sufffers from depression the case wont automatically fall. You'd have to establish by cogent evidences her medical condition and also how it may have afffected her discretion in filing the judgment.
