the property shlla be devolved between the children of your grandfather i.e. your father, your  father's brother and sister (are having equal rights).  so all of you smoothly decide and take your respective shares through elders or well wishers of your family.  the property of your father' share shall be devided between your mother, sister and your self (if necessary) or you may enjoy it jointly.  this is a suggestion.

Dear Sir/Madam,

The querry is regarding Hindu Succession Act 1956 and its amendment in 2005.

Mrs. A was born in 1957 and married in the year 1985.She is a native of Tamil Nadu and she is from a Hindu undivided family. Her father died in 1993 leaving behind his wife, two sons and three daughters including Mrs. A.  Her two sisters were born before 1956.

Is Hindu succession Act (amendment) 2005 applicable to the sisters? The family has got lands which are not partitioned till 20.12.2004 ?

Can a partition of HUF properties be made without the consent of the daughters by way of family arrangement between the brothers by unregistered document before 20.12.2004?

It is told that the elder sisters cannot claim on the basis of the above mentioned amendment because they were born before 1956.

Was there any succession at the time of death of the father in 1993 and whether the sisters are also coparceners at that time?

What are the grounds for  the Supreme Court Appeal in the case of Mrs.Pushpalatha.N.V.?

What is the court fees payable for partition of huf application by the sisters who are out of the state? Fixed fee or Ad-valorem fees

 Thank You

AK
