Mortgage Deed Registration

A Company owns two immovable properties, one situated at Delhi and another at Mumbai and wants to create mortgage in favour of a bank. The Company as well as the bank operate from Mumbai and have their respective reg offices at Mumbai..

QUERY: Can such mortgage deed by deposit of title deeds of both the properties be registered in Mumbai?

Hi Ayan,

As per my knowledge the property which is in mumbai can only be mortgaged through registerted mortgage.Bcz it is not possible to mortgage delhi's property through registerted mortgage in Mumbai,there is certain amount of stamp duy which is to be paid for registerted mortgage in a perticular state post that the mortgage deed must be register wih concern state's sub registrar office.

As per your question u r talking about equatable mortgage , and in this case both the properties can mortgage in mumbai.
