delay condon in 138

after receiving the usual reply of 138 legal notice, negotiation took long time and party denied to pay cheque amount.what is the best possible way to file case with delay condon application? is there any chance to accept application by Court?

U have to file now only civil case by paying court fee.he has bluffed u.
