Court Declaration on Adoption Deed under HAMA

Hi There, We have adopted a baby under HAMA from personal sources (from natural parents) and have the adoption deed registered at sub registrar office. We are Indian citizens residing in Australia and wiling to take the baby with us to Australia. However, Australian immigration may demand for NOC or clearance certificate from CARA (Central adoption resource authority) as adoption deed under HAMA may not be acceptable for immigration purposes. So we approached CARA and they have asked us to get a court order/declaration before they can issue a NOC. Hence, we would like to get a court declaration and submit it to CARA for the process of getting the NOC or clearance from them based upon our adoption under HAMA. So that we can proceed with the visa lodgement. Our questions are: 1. What is the process of getting a court declaration? How long does it take? 2. Understand that we need to file a declaration suit, What would be the language to request that adoption deed is valid and legal? 3. Can it be a prayer to the court requesting for the declaration or order? Please suggest. Thank you, Virendra Agrawal
