Kidnapping

Under section 361 there is an exception which states "this section does not extend to the act of any person who in good faith believes himself to be the fatehr of an illegitimate child, or who in good faith believes himself to the lawful custody of such child, unless such act is comitted for an immoral purpose."

Does this mean that a biological father can take away his son/daughter from mother's custody forcefully?

Unless you know the child is in someone else's custody who is not rightfully entitled for the same.

can a putative father claim visitation or custody of his illegitimate son from a woman whose husband is impotent and the common law cannot be applicable?
