Threat call by mahila thana

me & wife are living separately from 7+ months. i have filed a divorce case 3 months back.today my father received a call from mahila thana that i had to attend the thana today for mediation and they had sent the fax regarding this. she did not tell exactly what were the charges but it indicated domestic violence.

but i did not receive any such fax or information. she has given the date on next month i.e. august. she called from a different state.

should i attend the thana on the basis of just a phone call ?

or shud i wait for written notice?

how will i get the copy of complaint?

can the report be registered in other state ?

not appear when ever u receive written notice 

file RTI  n want complaint copy from ur wife local thana

If you belong to another state to that of the state the police station is situated, you may not honor the call given by police over phone because it cannot be confirmed that the caller was police or some person impersonating police.  Better don't take chance.  You may get the name of the officer summoning you and the name of the police station as well as the nature of complaint.  If you feel that this is something related to 498a or dowry issues, take the help of a lawyer , take AB and then visit the police station for inquiry/investigation.   Alternately you may wait for the police to send you communication to appear before them a per the provisions of section 41A of Cr.P.C.

Be kind to yourself.  Arrogance never pays before police.  They specialise in bigger arrogance.

 

Do not let the matter go on default. 

 

If you are innosent then state the same on every possible opportuinity.

 

These days telephone calls do have record.  They have called you they might have recorded the same.  Better avoid unnecessary annoyance of anyone when AB is not available in either state.

isn't he liable to receive formal notice at least?


Police may record things, but one can always plead, how do i know if the call is from the correct authority

 

he cannot run and start appearing in thane on every call claiming to be from mahila thana, especially if it is from a different state

You must insist upon written notice if you feel so. 

 

For you it is first case and for them you are neither first nor last one.

You did not disclose how/what  did the phone caller threat.  Please eloborate this may be essential for further advise.
