Lok Adalats

Lok Adalats are organised from time to time for settlement of cases and pre-litigation disputes as per the provisions of Sections 19 and 20 of Legal Services Authorities Act, 1987. The National Legal Services Authority (NALSA) through the State Legal Services Committee, District Legal Services Authorities and Taluk Legal Services Committee, has been organising Lok Adalats in the courts all over the country since the year 1995. During the last three years about 2.91 lakh Lok Adalats have been organised and about 94.40 lakh cases have been settled. Giving this information in written reply to a question in the Rajya Sabha, Shri Salman Khurshid, Minister for Law & Justice said that the said statistics will show the extent to which pendency of cases in the courts have come down by organizing Lok Adalats and thereby settling the cases pending before various courts.

It is proposed to make people aware about Lok Adalat by conducting more and more publicity programmes.

Dear Mr. Gupta,

I am an Advocate practicing since 1985. I have observed that nothing is done in Lok Adalats but it is just wastage of money and time both. The parties themselves settle their cases out of the Court and file compromise before the Courts, then the Courts fix the said case in Lok Adalat but the fact is that it is the parties who settle their disputes and there is no contribution of Lak Adalats therein except to get teh credit thereof without doing any thing.

It is true that MACP cases are settled in Lok Adalats but it can be settled in regular Courts also and there is no contribution of Lok Adalat in settleing those cases.

It is also evident to mention here that most of the cases settled in Lok Adalats are of Petty Offences, which can be settled by sending the summon fixing penalty and asking the person concerned either to pay penalty to the summon server or to appear before the Court on date fixed to face trial and there is such provision in Cr.P.C.

Therefore, Lok Adalat is nothing but the law for befooling the general publoc..

Your observations are very correct and I fully agree with the situation .

You have explained the matter appropriately.

The fact should be raised by all of us wherever possible to improve the situation.

If possible please consider about filing a writ petition or suggesting ways to change the scene.
