Rented shop

Hi,

We have a shop given on rent for the last 40yrs.

Now we want to use the same for our own use. We have given the termination notice as well. But after getting notice of termination he started renovation and changed the profession as well without our consult.

Please suggest what can we do in such case.

I stay at New delhi, near pitam pura. We are looking for a good property case Lawyer.

You can file a suit for eviction

Depending on the amount of rent per month, you can either file  suit for eviction before a civil court or a petition before Rent Controller.

Dear Querist,

 

Youve not mentioned the rent of the property that acrrues each month ? If it is less than 3.5 k then eviction would be a little problematic on the ground of bona fide requirement and may take some time. However if it is more than 3.5k then in that case - you can serve him a notice u/s 106 TPA and then file for eviction after 15 days.

Hi,

Thanks for your feedback. The monthly rent of the said property is Rs. 550/-.

We issued him a notice that we are terminating his tenancy as we require the shop for our own business one month back.

So in that case what are the chances of the case on bonafied requirement.
