Confirmation of services

Our company do not have standing orders, but we make everyone to undergo one year probation period before confirmation. Whether in the absence of standing orders, can we have one year as probation ?

Standing Order would be applicable only if the number of employees exceeds 100 (for Tamil Nadu). Does your Company has more than 100 employees/workmen. Also have you registered under the Shops & Establishment Act. Provide mroe details.

yes Mr.Vasudevan. Our company registered under shop and establishment act and do not have certified standing orders. But no of employees are more than 100. kindly clarify.

Model Standing Order as provided in the Industrial Establishment (Standing Orders) Act will come into automatic application for your establishment, unless you have formulated your own standing orders and got it certified by the labour authorities. Considering the cumbersome process, you may like to adopt the Model Standing Orders, which should be communicated to the employees and displayed in the notice board. In case you have two sets of employees i.e. workmen and non-workmen you may apply the model standing orders for the workmen and for the non-workmen may have a service rules/regulations or code of conduct in place. Usually the Model Standing orders provides for only 3 months probation. However, please check the Model Standing Order as applicable to Tamil Nadu for specific period.
