Can wife withdraw 498a after chargesheet is filed?

Page no : 2

T. Kalaiselvan, Advocate (Advocate)     04 April 2015

If she expresses no objection by an affidavit before the high court to the quash petition based on the compromise arrived, he high court may consider the quash of the 498a in respect of the persons but for that case at lower court should be split, consult your best lawyer about this issue. Actually if you have engaged a best lawyer, what was the need for a clarification at this portal, are you cross checking your so called best lawyer and his actions?

Sudhir Kumar, Advocate (Advocate)     07 May 2015

agreed with Mr Kalaiselvan.

As I can see in most of the questions, there is a difference of opinion by the experts. This is field where you cant define a certain case that this is exactly whats going to happen. There are multiple possibilities in each case when viewed from a different angle. There is a possibility that the best lawyer can also miss something as he is a normal human being. So I felt  getting a second opinion was better.

SAINATH DEVALLA (LEGAL CONSULTANT)     07 May 2015

Gentleman U have to ultimately rely on the wisdom and intelligence of UR lawyer for comming out of the case unscathed.

@Quest,  Law says 498A is a non-compoundable offence, hence can't be withdrawn once filed.

Is your lawyer trying to do something which is beyond the law ??????

Sudhir Kumar, Advocate (Advocate)     10 May 2015

Are you sure that they are sincerely interested in MCD.  Then only you can decide future course.

Misuse of women oriented laws is rampant. International movement to check it is going on.
