Ancestral property

Dear Sir,

Property- Karnataka- Ancestral

Family - 3 brothers - 2 sisters

Marriage date for sisters - before 1980

My father has divided the property to three brothers through registered partition  dead in the year 2002. Father expired in year 2003. As daughters can we claim equal share and reopen the partitioned deed. Please confirm.

as your father made the partition deed.  at the time of partition, your father might have been kept some share for himself (may be as nil).  Or he made a gift deed to your brothers.  so did your father make the partition or gift.  If your father made gift deed, now you cannot claim.

In karnataka as per amendment 1994 Women are entitled for equal share in fathers ansestral property.yes you can file a pettion in court

Dear Sir, Thanks for the replay

Father has done the register partition dead with brothers in the year 2002 , small part of the land has been left for his living. Same land he has written will it has to be dived only with brothers.

Dad expired in the year 2003 

we both sisters got married before 1980.
