Not by every one. The Akrama-Sakrama scheme, which is pending before the top court, seeks to regularise illegal constructions.

Akrama sakaram scheme is proposed to be intoduced to regularise past illegal constructions.
If you are occupying the government land without any base or any authority then you are considered to have done illegal encroachment of the government land and it is a punishable offence.
