Adoption of 3 children by stepfather

Dear Sirs,

I have 3 children (2 boys and 1 girl) all below 18 years of age. My first husband expired in 2009 and I remarried recently (Feb 2014) (in India) to a German citizen who is based in India. My new husband wants to adopt my 3 children as he has been very active in their lives since the death of their biological father. The lawyer who I approached said it is not possible for him to adopt them as "Only orphaned, abandoned or surrendered children" can be adopted. So instead he asked us to go for a legal guardianship deed and he claims to have submitted the same to the court.

I have enquired from various sources and they say that it is possible for my husband to adopt my children, but I do not find any documentation which I can give to my lawyer to confirm the same.

Can someone please help me find some solution to this problem, also what will be the status of the birth certificates of my children where my name is documented as my former married name. Now I have changed it legally.
