How to be wise at the Police Station ?

 

I have as usual, given some key points, before the Five Point Strategy to deal with the Police, has been mentioned. This five-point strategy is what your advocate too does and this is what any retired police officer too would suggest and this is what any LITERATE, SENSIBLE AND NORMAL person would do. I have listed that five point strategy. 

 

Readers and Members, these might seem to be very basic points and without glamour, but life is plain life at it's simple best. It is people who complicate their own life and other's lives and create artificial worlds far from truth and reality and thereby drown in falsity. Please remember that. 

 

Your distance from the Truth decides your struggle, both mentally and monetarily.

 

If you are closer to the Truth, neither can the police continue to trouble you nor can your advocate burn your pocket.

 

If you are far away from the Truth, you will have to spend time at the police station for lengthy hours and pay a hefty sum to your advocate too.

 

When you maintain the LEGAL APPROACH, you are creating a LEGAL DISTANCE between you and the police and ONLY WHEN YOU MAINTAIN THE LEGAL DISTANCE from the police, they cannot harm you. Remember therefore, to always PLAY IT LEGALLY SAFE.

 

Remember few key points.

 

Every police officer, whether a constable or the senior most, he/she knows that their profession is the only profession where they can be subjected to the most severe of punishments by the courts, human rights commission, media and the public if their luck runs out.

 

So, every police official, especially in today’s technology era and NGOs and awareness drives, calculates every risk he/she takes.

 

Every move is a calculated one.

 

But the age old attitude of the police remains.

 

What is that age old attitude ?

 

The faulty thinking pattern that a complainant does not know anything about the law.

 

The moment you flassh the police act and the police manual, most of them would step back and deal with your case with caution.

 

In the bare minimum, most of them, would not shout at you, if they see that you know the law.

 

They know that they are dealing with an INTELLIGENT complainant and respondent, who KNOWS THE LAW.

 

But do not assume that they would salute you.

 

The Police have their own network of advocates who almost always play to the ego-gratification of the police, since there are many benefits in doing so. From being referred as a good advocate, to a freshly arrested citizen, to being received well while at the police station, there are many benefits and hence such advocates would readily present the method to complicate a law which the police would hurl at you.

 

Similar to borrowing your neighbour’s match-stick and lighting you afire.

 

But by and large, irrespective of what anybody suggests and/or advises, no police official would want to be suspended/ dismissed, although a high level of NEGATIVE EGO is shown by many of them.

 

An advocate is a free-lance professional.

 

But the police is a government employee with all benefits, even after retirement                         ( PF, Pension,…etc  ).

 

So, usually most of the police officials move with caution and play it safe.

 

But their levels of negative ego are usually very high. So, swim through their ego and never rub their negative ego. It is very very risky. There are many damages that they can do and remain safe as well. By the time you prove yourself innocent and file a complaint against the police and seek compensation from the Home Department, years would have rolled by and life would take a strange turn.

 

This fact of life is exactly what the faulty police mis-use to suit their negative ego and pockets.

So, swim through their ego and never rub their negative ego.

So, even before you respond to the police by reply-notice or visit them upon summons, first understand these FIVE STRATEGIC points.

 

1) The Offence that you have committed, as per the IPC and CrPC

 

2) The other sections of the law, under IPC and the CrPC,  that can be added to this offence and invoked against you.

 

3) The act as per the Police Act of your state and what are the sections that apply to your case and can be invoked against you.

 

4) Most Importantly, the Police Manual and the method it lists for the police to invoke the act and the law to be invoked against you.

 

Say, for instance, a woman and a person of age 15 yrs and below can REFUSE to go to the police station.

 

Or as another instance, police cannot hand-cuff you and take you to the police station in such a way that it amounts to lowering your dignity and image in society.

 

5) The Citizens’ Charter that the Police Commissioner would have already circulated to the police stations along with instructions to be implemented.

 

A citizen’s charter is not legally binding but it can be given a legal push, if a matter reaches court, against Police Atrocity.

Like this, you would come to know of the details of the working methodologies of the police and the law and order wing, as dictated by Law.

 

When you speak to the police, always keep it precise, keep it summarized version. Neither too lengthy speech nor too short.

 

Always, with the police, maintain everything on record.

 

Complaint by writing.

 

Reply by writing.

 

Keep everything on record.

 

Take photo-copies and obtain acknowledgement receipts.

 

When you start discussing with the police, keep bringing in references to the Police Act and Police Manual.

 

Bring in a reference even to the IPC and CrPC.

 

If you suspect wrong treatment, record the conversation on your mobile or a recording device.

 

The moment the police realizes that you are an intelligent complainant or respondent with knowledge of the law, they will attempt to quickly close the case or push the file away to the court from where it is the usual legal frame-work and purely legal administration that would be handled by your advocate.

 

When you keep bringing in your case to fit in, into the frame-work of the Police Act, the Police Manual, the IPC and the CrPC along with the citizens’ charter,  you remain safe by knowing it too very well if you are on the wrong side and how you can be punished and within the legal frame-work.

 

YOU CANNOT BE HANGED OR KILLED unless you psychologically and mentally submit yourself as a “ DEFEATED PERSON EVEN BEFORE THE LEGAL BATTLE BEGAN “, to your opponent and the police.

 

If you are foolish enough to collapse in front of the police, out of fear, In such a scenario of

YOUR FOOLISHNESS, you will lose

 

a) Your Time, Your Money and Your Energy

 

b) Your Peace of Mind

 

c) Your Safety and Security

 

d) Your Mental Balance

 

e) Your LIFE  BALANCE and NATURAL RHYTHM of LIFE.

 

If you are on the right side, even in such a scenario, you will know how to get the opponent, to the book and how to clamp him/ her down.

 

BUT REMEMBER ONE GUIDE-LINE

 

NEVER ACT OVER-SMART WITH THE POLICE AND NEVER TRY TO DOMINATE.

 

YOU WILL END UP WITH LOT OF DAMAGE.

 

NEVER FORGET THAT THEY ARE PAID GOVERNMENT EMPLOYEES WHO WORK IN AN ATMOSPHERE WHERE THE LAW CAN BE PUT TO GOOD USE AND ALSO BE ABUSED AND MIS-USED.

 

SO, WITH THE POLICE, ALWAYS BE PROFESSIONAL AND GO BY THE RULES.

 

Yes, sometimes rules have to be bent, as a PRACTICAL FLEXIBILITY. If you are a law-abiding citizen, the situations for being flexible will automatically become clear to you.

 

SO, WITH THE POLICE, NO MORE FEAR.

 

BE STRONG AND ALWAYS ACCOMODATE YOUR CASE WITHIN THE POLICE ACT, THE POLICE MANUAL, THE IPC, THE CrPC AND THE CITIZENS' CHARTER ALONG WITH EARLIER COURT JUDGEMENTS ( IF AVAILABLE ). ONCE YOU SEE THIS THERMOMETER, YOU WILL KNOW BY YOURSELF THE RIGHT DIRECTION, SINCE EVERY MOVE OF YOURS WILL BEAR EITHER A POSITIVE OR NEGATIVE IMPACT UPON YOUR OWN LIFE AND YOUR FAMILY AND YOUR FUTURE.

This post would have been even better if you would have cited what a husband has to know/behave /do at police station when suddenly out of the blue he & family members are falsely implicated with cases like 498a / DV.
