Urgen help needed consumer court

THIS WAS THE COMPLAINT FILED BY ME AND TOMORROW I HAVE TO SUBMIT AFFIDAVIT OF EVIDENCE.

This complaint petition is being filed by Mr. Sangeet Jain, 8/50, 1st floor, Geeta Colony, Delhi-110031, referred hereafter as Complainant,  and is as follows : 

(Narration of the incident)

·         That on 3rd June 2013 (date of purchase), the complainant bought a phone “Xolo-Q800” from a dealer sold under the brand of XOLO and owned by the Opposite party.


·         That on 22nd August 2013, the complainant started facing some problems with the touch screen of the phone and called up the customer care and as told by customer care of the opposite party submitted the phone at an authorized collection point of the company at:

Mayur Vihar Ph-1, New Delhi.

·         That while submitting the phone the complainant was told that the phone will be serviced within 5 days and complainant will be notified with email or sms.

·         That after 5 days complainant did not receive any sms or email that the phone has been serviced. Hence complainant called the customer care and was told to wait for 2-3 days.

·         That after 4 days complainant again called the customer care and was again told to wait for some more days.

·         That on calling again and again, when no response in given by the customer care of the opposite party, complainant wrote an email on 28th September 2013 to the customer care of the opposite party and in response was told that the phone is still under repair and will be dispatched soon.

·         That in the coming days complainant called again and again regarding the status of the phone and every time was told to wait.

·         That on 12th October Complainant again emailed the customer care of the opposite party and asked to return the phone and in response was told that the phone will be dispatched soon.

·         That in the coming days complainant called again and again regarding the status of the phone and every time was told to wait.

That the opposite party has inflicted enormous amount of mental agony and financial loss on the Complainant.
