Uds allocated is more than land available

The Apartment, a residential building is built on land of 19181.61 Sq.Feet (as per documents available with me).  The un divided share allocated to each of the flat owners is 383 sq.feet.  As of now there are 52 flats in the building, therefore 52 X 383 = 19916 sq.feet is allocated.

The builder was supposed to construct 48 flats (approved plan). he has constructed an additional floor with 4 largers flats and has sold 3 of them.  

Going by his allocation of UDS to all, can this be challenged in court of law.  I have raised this issue a year back (and continuously raising this with builder and with other residents) and no response received so far.

The flat is registered in May, 2014.  The project is completed in 2013-2014 (as per documents, khata issued and propoerty tax paid by individuals).
