Transfer of property from mother to son

My Mother wants to transfer a flat in housing Society in Mumbai to me via Gift Deed.

Now my query is the Gift deed has to be Registered.

My society is saying that they don't issue NOC for transfering property between Family Members by Gift deed.

For Registration of Gift Deed property transfer between family member do we require to take NOC from housing society and is it Mandatory to submit it at the time of registration.

 

With out Society NOC can we Regsiter the Gift Deed Property transfer documents.

If the flat is in your mothers name then she can transfer her flat by making a registered gift deed in favour of you, she need not take any noc / permission from any body, she has all rights over that flat .
